California Legislature Begins Voting on Housing Bills

At J & H Asset Property Management, we pride ourselves on keeping our clients apprised of bills and new laws that can affect them, their communities, and their residents. Our legal counsel and Thomas Pacelli, Vice President of Operations who is also on the Western Manufactured Housing Communities Association (WMA) legal committee, are monitoring the following bills that might affect our industry in 2024.

  • Senate Bill 1108 would require park owners to receive a 90-day notice of a resident violation that, if left uncorrected, could place the park’s Permit to Operate (PTO) at risk. You can read more about the bill here.
  • Senate Bill 1095 would mandate that mobile homes be allowed to convert to all-electric appliances regardless of the mobile home park’s existing electrical system. Industry representatives testified against this Bill due to it not specifying who would be responsible for paying for the utility upgrades that may be required to comply with the legislation. For example, if a mobile home park has a 30-amp system, the increased load due to converting appliances from gas to electricity may require a costly upgrade. SB 1095 would also require HCD or a local enforcement agency to change its regulations to allow for installing appliances outside of the home. Please read more here.
  • Assembly Bill 2387 would exempt new spaces constructed in existing mobile home parks from local fees and taxes not currently levied on other spaces in the park. This could ensure that community areas currently used for RV and boat storage can be converted to new housing. This bill limits the number of new spaces that are exempt from fees and taxes to 10% of the permitted spaces currently allowed in the park. For example, the bill would allow for 10 new spaces to be constructed in an existing 100-space mobile home park.
